Ask Dave

Liable For Spouse's Debt?

Bob is not responsible for his deceased wife’s credit card debt, only on those that he co-signed, as well as estate debts.

QUESTION: Bob’s wife just died and he found out she had a credit card in her name.  Is he liable for the debt?

ANSWER: You’re not responsible for your deceased wife’s debts unless you signed on her loans.  Her estate, anything she owned, is liable for her debts though.  For example, if you owned a house together, it is part of her estate.  Anything she owned or that you owned together must be used to cover her debts.
